知识产权的特点

Characteristics of intellectual property:

（1）独占性。是指专利权是一种无形财产权，具有排他性质，任何人要实施专利，除法律另有规定的以外，必须得到专利权人的许可，并按双方协议支付使用费，否则构成侵权。

Exclusivity. Patent right is a kind of intangible property right, which is exclusive. If anyone wants to implement the patent, unless otherwise provided by law, he must obtain the permission of the patentee and pay the royalties according to the agreement between the two parties, otherwise it will constitute infringement.

（2）时间性。是指专利权只在授权有效期限内有效，期限届满或终止失效后该发明创造就成为全社会的共同财富，任何人都可以自由利用，专利权的期限是由专利法规定的。

Time. It means that the patent right is valid only within the term of validity of the authorization, and after the expiration or termination of the period of validity, the invention and creation will become the common wealth of the whole society, and anyone can use it freely, and the term of the patent right is prescribed by the Patent Law.

（3）地域性。是指一个国家授予的专利权只在授予国或地区的区域范围内有效，对其它国家或地区没有法律约束力，每个国家或地区所授予的专利权，其效力是互相独立的。

Regional. It means that the patent right granted by a country is valid only within the regional scope of the granting country or region, and is not legally binding on other countries or regions. The patent right granted by each country or region is independent of each other.
